Unntakstilstand


Unntakstilstand eller unnatakstilstand er ein samfunnstilstand der vanleg lov og rett er sett ut av kraft. Dette kan til dømes innførast ved krig eller kriser som naturkatastrofar eller opprør. Ved ein sivil unntakstilstand ligg makta hjå regjeringa, mens under ein militær unntakstilstand vil det militære ha makta. Unntakstilstanden kan omfatta eit heilt land eller eit mindre område.


I nokre land finst lovar som seier kva tid og korleis ein kan erklæra unntakstilstand. Omgrepet er ikkje brukt i norske lovar men Beredskapslovene kan takast i bruk dersom krig eller ein krigsliknande tilstand hinder Stortinget i å tre saman.
